Agreement to these Terms

By accessing or using the Services, you agree to these Terms of Service and any policies expressly incorporated into them. If you do not agree, you must not use the Services.

If you use the Services on behalf of a company or another organization, you represent that you have authority to bind that organization. In that situation, “you” includes both you and the organization.

The version of these Terms posted when you place an order will apply to that transaction unless a change is required by law or you expressly agree to a different version.

Eligibility and authority

You must be at least the age of majority in your state or place of residence to make a purchase. If you permit a minor to use a product, you are responsible for appropriate adult supervision and for reviewing all product warnings and instructions.

You represent that information supplied through the Services is accurate, current, and complete. You may not place an order or use the Services for an unlawful, fraudulent, deceptive, or unauthorized purpose.

Accounts and security

Some features may allow or require an account. You are responsible for safeguarding your login credentials and for activity performed through your account. Do not share credentials with anyone who is not authorized to act for you.

Please notify us promptly if you believe your account has been accessed without permission. We may require reasonable verification before changing account details, discussing an order, or releasing account information.

We may suspend or restrict an account when reasonably necessary to protect customers, investigate suspected fraud, comply with law, or prevent misuse of the Services.

Products and compatibility

We aim to describe products accurately. Product colors, finishes, scale, packaging, and appearance may vary slightly because of display settings, photography, manufacturing updates, or normal production differences.

Certain smart pet products may require compatible devices, Wi-Fi, Bluetooth, mobile applications, batteries, subscriptions, location services, or third-party accounts. Unless expressly stated otherwise, those requirements are not included with the product. Review the product page and manufacturer documentation before purchase and use.

Product images are illustrative of the item offered, but accessories, animals, furniture, or decorative objects shown in lifestyle photography may not be included. The written product description and selected variant determine what is included.

Availability is not guaranteed. We may update, discontinue, limit, or correct a product listing before accepting an order.

Orders, pricing, and payment

Your order is an offer to purchase. An automated order-receipt message confirms that we received your request but does not by itself mean that we accepted it. Acceptance occurs when we send a shipping confirmation or otherwise expressly confirm acceptance.

We may decline, limit, or cancel an order before acceptance for reasons including:

• Product unavailability or an inventory discrepancy.
• An obvious pricing, description, or promotional error.
• Payment authorization failure or suspected unauthorized activity.
• Shipping restrictions, address issues, or legal requirements.
• Quantity limits or suspected resale activity inconsistent with an offer.

If we cancel an order after payment has been captured, we will issue a refund to the original payment method for the canceled amount.

Prices are shown in the currency displayed at checkout. Applicable taxes and any other required charges will be shown before the order is submitted. You authorize us and our payment providers to charge the payment method you select for the total shown at checkout.

Shipping and delivery

Tailnexa currently offers free standard shipping on products available for purchase through our website. Estimated delivery is generally 3–5 business days unless a different estimate appears on the product page, at checkout, or in your order confirmation.

Delivery dates are estimates rather than guarantees. Weather, carrier interruptions, address problems, peak periods, product availability, and events outside reasonable control may affect delivery.

If we learn that an order cannot ship within the promised timeframe, we will provide notice and any cancellation, consent, or refund options required by applicable law. Please review shipping information carefully and provide a complete, accurate delivery address.

Title and risk of loss transfer as provided by applicable law. Nothing in this section limits responsibility that cannot legally be excluded.

Returns, exchanges, and refunds

Eligible products may be returned or exchanged free of charge within 30 days, subject to the conditions disclosed in our current return policy. Items should be returned with included parts, accessories, manuals, and original packaging when reasonably possible.

Certain products may be ineligible for return when exclusion is permitted by law, including items that are personalized, used in a way that creates a hygiene concern, damaged after delivery, missing essential components, or otherwise identified as final sale before purchase.

We may inspect returned products before approving a refund or exchange. Approved refunds are normally sent to the original payment method. Processing times may vary by financial institution.

These terms do not reduce any warranty, rejection, cancellation, refund, or other remedy that cannot be limited under applicable law.

Promotions and discounts

Selected promotional products may receive an automatic discount of up to 20% when the offer is displayed. Promotions may be limited by product, quantity, customer, region, time, or availability.

Unless expressly stated otherwise, promotional offers cannot be combined, applied retroactively, exchanged for cash, or transferred. Returns of discounted items are refunded based on the amount actually paid.

We may correct or withdraw an offer affected by a technical, pricing, or publication error before an order is accepted. We will not alter the accepted price of an order except with your agreement or when legally permitted.

Acceptable use

You may not use the Services to:

• Violate a law, regulation, court order, or the rights of another person.
• Transmit malicious code, interfere with security, or disrupt website operation.
• Access accounts, systems, or information without authorization.
• Scrape, harvest, copy, or extract content through automated means without written permission.
• Impersonate another person or submit false, misleading, or fraudulent information.
• Place orders through abusive automation or circumvent product and promotion limits.
• Use the Services to distribute spam, unlawful material, or harmful content.

We may investigate suspected misuse and take proportionate action, including restricting access, canceling affected transactions, preserving records, and cooperating with lawful requests.

Reviews and submitted content

If you submit a review, photograph, suggestion, testimonial, or other content, you retain ownership of content you own. You grant Tailnexa a non-exclusive, worldwide, royalty-free license to host, reproduce, format, display, and distribute that content for operating, improving, and promoting the Services.

You represent that you have the rights needed to submit the content and that it is accurate, lawful, and does not infringe another person’s privacy, intellectual property, or other rights.

We may moderate or remove submitted content that violates these Terms, is unrelated to the product or service, contains personal information, appears fraudulent, or is otherwise unlawful. We will not prohibit or penalize an honest review merely because it expresses a negative opinion.

Intellectual property

The Services and their original text, branding, layouts, graphics, photographs, videos, software, and other materials are owned by or licensed to Tailnexa and are protected by applicable intellectual property laws.

We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for their intended purpose. This permission does not allow you to reproduce, sell, publish, modify, reverse engineer, or commercially exploit protected material without authorization.

Product names, brand names, and trademarks belonging to third parties remain the property of their respective owners. Their appearance does not imply sponsorship or endorsement unless expressly stated.

Third-party services

The Services may rely on third parties for payment processing, hosting, analytics, shipping, communications, product applications, or other functions. Your use of a third-party service may be governed by that provider’s own terms and privacy practices.

Links to third-party websites are provided for convenience and do not make us responsible for their content, security, availability, or practices. Review third-party terms before using their services or providing information.

Some connected pet devices may stop supporting a feature if a manufacturer changes its application, network, subscription, or technical requirements. We do not control independent third-party platforms, but your statutory rights relating to the product remain unaffected.

Privacy and communications

Information collected through the Services is handled according to our applicable privacy disclosures. Transactional messages may be sent when reasonably necessary to administer your account, process an order, provide security notices, or respond to a request.

Marketing communications are subject to the preferences and choices provided to you. You may withdraw marketing consent through the method described in the applicable message, although this will not stop necessary transactional communications.

Disclaimers

To the fullest extent permitted by law, the Services are provided on an “as available” basis. We do not guarantee that the website will always be uninterrupted, error-free, secure, or compatible with every device or browser.

Product-specific warranties, if any, are described with the product or supplied by the manufacturer. Except for express warranties and rights that cannot be excluded, we disclaim implied warranties to the extent legally permitted.

Pet behavior, health, environment, connectivity, and product installation vary. We do not guarantee that a device will prevent every escape, injury, illness, loss, unwanted behavior, or property incident.

Limitation of liability

To the fullest extent permitted by applicable law, Tailnexa and its service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the Services or products.

Where liability may lawfully be limited, our aggregate liability relating to a claim will not exceed the amount you paid to Tailnexa for the product or transaction giving rise to that claim.

These limitations do not apply to fraud, willful misconduct, personal injury caused by negligence where liability cannot be limited, or any consumer right or remedy that applicable law does not allow us to exclude.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold Tailnexa harmless from third-party claims, losses, and reasonable expenses arising from your unlawful misuse of the Services, your violation of these Terms, or content you submit that infringes another person’s rights.

This obligation does not require you to indemnify Tailnexa for our own negligence, unlawful conduct, or responsibility that cannot legally be transferred to you.

Governing law and disputes

These Terms are governed by the laws of the State of Rhode Island and applicable federal law, without regard to conflict-of-law principles. Any legal proceeding may be brought in a court with lawful jurisdiction in Rhode Island, except where applicable law gives you the right to bring a claim elsewhere.

Before beginning formal proceedings, you and Tailnexa are encouraged to attempt to resolve the issue through a good-faith written discussion. This informal step does not extend or waive any legal filing deadline unless agreed in writing.

Nothing in these Terms prevents either party from seeking relief in small claims court when eligible or reporting a matter to an appropriate government agency.

Changes to the Services or Terms

We may update the Services and these Terms to reflect operational, technical, legal, security, or business changes. The updated version will display a revised effective date.

Material changes apply prospectively unless a different approach is required by law. Continued use after an updated version takes effect constitutes acceptance of the revised Terms, but changes will not retroactively alter an accepted order without a lawful basis.

Termination and survival

You may stop using the Services at any time. We may suspend or terminate access when you materially violate these Terms, create security or legal risk, engage in fraud, or misuse the Services.

Provisions that by their nature should continue after termination will survive, including provisions concerning ownership, submitted content licenses, disclaimers, liability, indemnification, disputes, and amounts already owed.

General provisions

These Terms and incorporated policies form the entire agreement concerning the Services and replace prior discussions concerning the same subject. Product-specific written terms may supplement these Terms.

If a provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver.

You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a merger, reorganization, sale of assets, or transfer of the relevant business, subject to applicable law.
